1. Agreement to Terms

By accessing or using cscus.net (the “Site”) and purchasing products from cscus.net — Godspeed New York (“we,” “us,” or “our”), you agree to be bound by these Terms & Conditions (the “Terms”) and our Privacy Policy. If you do not agree, you may not use the Site or purchase our products.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to make a purchase. By placing an order, you represent that the information you provide is accurate and complete.

3. Products & Availability

• Products, including limited drops and made‑to‑order items, may be available in limited quantities and may sell out without notice.
• We strive for accurate product imagery and descriptions; however, color tones, materials, and sizing may vary slightly due to display settings, production tolerances, or dye lots.
• We reserve the right to discontinue or modify products at any time.

4. Pricing, Taxes & Payment

• Prices are listed in USD unless stated otherwise. Taxes, shipping, and fees will be calculated at checkout based on your delivery address.
• We accept major payment methods shown at checkout. By submitting payment information, you represent that you are authorized to use the chosen payment method.
• We may correct pricing errors and cancel or adjust orders that contain incorrect pricing, even after submission, if permitted by applicable law.

5. Orders & Acceptance

• Your order constitutes an offer to purchase. We accept your offer only when we send an order confirmation and, for physical goods, when we dispatch the product.
• We may refuse or cancel an order for reasons including product availability, suspected fraud, errors, or violations of these Terms.
• Once placed, orders may not be modified; if you need changes, contact support promptly. We cannot guarantee adjustments after submission.

6. Shipping & Delivery

• Shipping options, costs, and estimated delivery windows are shown at checkout. Estimates are not guarantees; carrier delays or customs may extend delivery times.
• Risk of loss transfers to you upon delivery to the address you provided. Ensure your address is accurate and secure. Title transfers upon shipment.
• For preorders or made‑to‑order items, allow additional lead time as communicated on the product page or confirmation email.

7. Returns, Exchanges & Refunds

• Items must be unworn, unwashed, and in original condition with tags. Certain categories (limited drops, final sale, gift cards) may be non‑returnable unless defective.
• Return shipping costs may apply. Refunds are issued to the original payment method after inspection.

8. Preorders & Limited Drops

• Preorders reserve an item before production or release. Estimated ship windows are provided but may shift due to manufacturing or supply factors.
• Limited drops are produced in finite quantities and may be subject to purchase limits per customer or household.
• We may cancel orders that appear to be placed by bots, resellers, or exceed quantity limits.

9. Promotions, Discounts & Gift Cards

• Promotional offers are valid only for the stated period and conditions. Unless specified, promotions cannot be combined and exclude tax and shipping.
• Discount codes must be entered at checkout and cannot be applied retroactively.
• Gift cards are final sale, non‑refundable, and redeemable only on the Site. Lost or stolen gift cards will not be replaced.

10. Accounts & Security

• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• Notify us immediately of any unauthorized access or suspected breach. We may suspend or terminate accounts for abusive or fraudulent activity.

11. Intellectual Property

The Site, its content, logos, graphics, product names, artwork, and designs (including “Godspeed New York”) are owned by cscus.net or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission.

12. User Content & Reviews

• By submitting reviews, images, or other content, you grant us a non‑exclusive, worldwide, royalty‑free license to use, reproduce, publish, and display such content in connection with the Site and our marketing.
• You represent that your content is accurate, lawful, and does not infringe any third‑party rights. We may remove content at our discretion.

13. Third‑Party Services

The Site may contain links to third‑party sites or use third‑party services (such as payment processors). We do not control and are not responsible for their content, policies, or practices. Your use of third‑party services is at your own risk and subject to their terms.

14. Warranties & Disclaimers

• Except as expressly stated, products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non‑infringement.
• We do not guarantee uninterrupted or error‑free operation of the Site.

15. Limitation of Liability

To the fullest extent permitted by law, in no event will cscus.net, its owners, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or related to your use of the Site or purchase of products, even if advised of the possibility of such damages. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.

16. Indemnification

You agree to indemnify, defend, and hold harmless cscus.net and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or related to your use of the Site, violation of these Terms, or infringement of any rights of a third party.

17. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

18. Dispute Resolution

• Arbitration: Except where prohibited, any dispute arising out of these Terms or your use of the Site shall be resolved by binding arbitration administered in New York County, New York. You and we waive the right to a jury trial and to participate in a class action. Each party bears its own costs, subject to applicable law.
• Small claims: Either party may bring a claim in small claims court if eligible.

19. Miscellaneous

• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.
• Entire agreement: These Terms, together with policies referenced herein, constitute the entire agreement between you and cscus.net regarding the Site and products.
• No waiver: Our failure to enforce any provision is not a waiver of our right to do so later.

20. Changes to Terms

We may update these Terms from time to time. Changes take effect when posted on this page with an updated “Last updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
